the prior approval of the Secretary of State, many instances

have been found where no such authority was sought and,

occasionally, where even the Executive Council was not consulted.

Apart from particular cases which have been submitted

to the Colonial Office for approval I do not find any clear

guidance on this subject, apart from a casual reference in Mr.

Lyttleton's despatch No.411 of 14th November, 1903, and the

general injunction, contained in Lord Stanley's early despatch

No.31 of 31st January, 1844, regarding the desirability of

Public Auction as the means of alienating Crown Land. But I

have no doubt that this question has arisen in other dependencies.

6. In this Colony, which is predominantly urban and

greatly overcrowded, I should not favour the indiscriminate

erection of churches and chapels; and where a case can be made

for the necessity of such I should incline to a lease for the

usual term of years by private treaty at normal upset price

together with a nominal Crown Rent for so long as the area is

exclusively used for the religious purpose in question.

Secretary of State after consultation with the Executive Council.
