China Treaty.

Your telegram 9201 of 18th November.

My immediately following telegram contains toxt of draft minute which His Majesty's Ambassador, Chungking, was instructed on 17th November to ask Chinese Government at an appropriate moment to accept. It would apply to all territories covered by Treaty. I interpret your telegram to mean that on balance you consider these instructions should stand.

2. Chinese Government presented amended draft Treaty to His Majesty's Ambassador on 13th November. It is now under considoration with United States Government. Main changes from our draft are:-

(a)- Additional article "Relations between the Republic of China and the United Kingdom of Great Britain and Northern Ireland and India shall be based on the principle of equality and reciprocity". United States Government dislike this and we shall support them.

Provision for termination of Kowloon Loase of 1898.

Omission of reference to commerce in second sentence of Article 6.

(a) Provision in Article 7 for most-favoured-nation rights regarding location of consular officers is replaced by provision for their location at places agreed upon. We shall accept this which makes unnecessary reservation regarding location of consular officer at your headquarters.

(c)

Exchange of letters providing that treaty port system, special courts at Shanghai, the carrying on of coastal trade and inland navigation by foreign nationals, the employment of foreign pilots, the employment of a foreigner as Inspector-General of Maritime Customs and the entering of foreign warships into Chinese ports without previous consent are abrogated.
