My telegram D. No. 463 of 16th November and No. 489 of 28th November.
1. His Majesty's Ambassador Chungking has now been sent instructions as to reply to Chinese Government's counter proposals. Principal points are as follows:-
(A) Proposed new article basing relations on principle of equality and reciprocity. His Majesty's Ambassador will reply to Chinese Government on lines similar to reply proposed by United States Government (see my telegrams D. Nos. 463, paragraph 5 and 409 paragraph 2). But in endeavour to meet Chinese wishes His Majesty's Ambassaor will offer to amend paragraph 2 of the Preamble (see my telegram D. No. 419 of 17th October) as follows:-
Being desirous of defining more clearly the general relations between them in a spirit of friendship on a basis of equality and in accordance with modern international practice".
(B) Kowloon, His Majesty's Ambassador will say that he still
awaits instructions.

(C) National treatment for the carrying on of commerce. States Government are agreeing to give up national treatment for their commernce since they are unable to reciprocate owing to difficulties of Federal and State legislation. But as United Kingdom Government can reciprocate in the territories to which the Treaty applies and wish to continue existing practice in all respects, His Majesty's Ambassador will reply on lines of ny telegram D. No. 489, paragraph 5.
(D) His Majesty's Ambassador has also been sent instructions as to the draft Exchange of Notes suggested by the Chinese Government (see my telegram D. No. 463 of 16th November, para,raph 2(c)). Notes will cover following points inter alia:-
(a) Treaty ports system to be abolished. Pending conclusion of comprehensive treaty merchant vessels of one H.C.P. to be permitted to come into ports etc. of the other H.C.. which are open to overseas merchant shipping and to be accorded national treatment. "Vessels" defined as vessels registered under the law of the territory of the H.C.P. to which the Treaty applies.
(b) Special courts in international settlements at Shanghai and Amoy abolished
(c) Employment of foreign pilots in Chinese waters
