Your telegram No.228 of 21st October. extra-territoriality.

United Kingdom Government are grateful for views of Canadian Government. Draft treety contained in my telegram D No.439 of 17th October follows as closely as possible draft United States-China treaty drawn up by United States Government watch includes articles generally similar to Articles 6, 7 and 8 of United Kingdom draft. Amendments to these and other articles in United Kingdon draft telegraphed in my telegram D No.428 have also been made in discussion with United States. In order to facilitato negotiations with Chinese Government both we and U.S. Goverment are anxious to have the two treaties as nearly identical as possible.

Moreover if subjecte dealt with in Article 6, 7 and 2 were left over for subsequent negotiation certain rights at present enjoyed in China as for example right to travel, reside and carry on trade would lapse. Although, this is perhaps not of very great immediate practical importance it might result in inconvenience later especially if negotiation of second tresty should be delayed.
3. Whilst therefore we see force of Canadian Government's 26
view contained in paragraphs 5 and 4 of your telegram No.228 we attach importance to advantage of securing as nearly as possible identity of texts between United Kingdom and United States drafts and are also influenced by considerations set out in paragraph 2 above. If however Canadian Government prefer to follow different course we should see ne objection from United Kingdom point of vier.
