With reference to our telo hone conversation of this morning i have sent you separately a copy of a letter of 22nd Cetober from the United States basse. Or regarding the extru territoriality treaty and a copy of our reply.
Most of tie is self-explanator,
but perhaps
an additional word is required about the amendment to cover nati nal treatment for commerce etc. which we have been trying to persuade the Americans to accept in Article 5 of their draft (rticle 6 of ours. You wil1 aee that the United States Government are very reluctant to do this, and as the question is likely to be a highly contentious one with the Chinese it is practi- cally certain that we should not et what we want in e shoul this matter without fall merican suport. not only meet ith a rebuff from the Chinese and probably annoy the State Department, but we should also lose to no purpose the advantage of presenting what would otherwise be practically identic refta.
In these circumstances we have agreed to drop our proposed addition if the State Department definitely rejects it.
I am sending a copy of this letter and its enclosures to kumbolé india office, Costar, Dominions office, Norman Young, Treasury, and Monson, Coloniel Office.
