18514. Your telegram No. 8364 of 21st October. Treaty. I am grateful for your speedy.reply. Treaty will be negotiated in Chungking and I suggest that most appropriate signatory for India is Seymour.

You

Chinese would probably not make any special difficulty regarding reservation proposed by you to Article 6. will, however, realise that this reservation could be used in such a way as to leave practically no content in Article 6 in its application between India and China as regards traval, residence and commerce and that it would leave the Chinese free to impose very drastic restrictions on Indians in China. The reservation to Article 6 proposed in my telegram No. 20 18176 is not open to this objection, might be of value to you particularly in Sinkiang and seems to protect most of your difficulties in India regarding this Article. We think the danger of the Chinese claiming under proposed Treaty exemption for their nationals from wartime restrictions is negligible, and U.K. are not making any reservation on this point.

3. There is no objection to your reservations being made by exchange of notes and following draft is suggested if you accept view expressed in paragraph 2 above. Begins:- My signature to the Treaty on behalf of India is subject to the reservations that:-
