With reference to Mr. Seel's minute above, I have arranged for him to accompany me to a meeting at the Foreign Office tomorrow morning to discuss the letter from the U.S. Ambassador at 77 above. This letter asks for our observations on a message from the State Department containing the amendments to the U.S. draft which the Chinese Government have suggested. Similarly the Chinese Government have suggested amendments to H.M. Ambassador in Chungking to the U.K. draft.

To both drafts the Chinese have proposed adding an Article in the first place, reading:- "The relations between the Republic of China and the United States of America/the United Kingdom shall be based on principles of equality and reciprocity".

The Americans are rather frightened of this amendment which they think is in some way connected with their own restrictions on Chinese immigration into the United States. They are, therefore, suggesting that they might say to the Chinese that the suggested Article seems to be an unnecessary addition because the Treaty speaks for itself; that the facts of our relationships as exemplified in the Treaty are more important than distinctive phrases; and that their idea of the present Treaty has been that the relinquishment of "extra-territorial and special rights" and such related questions as require attention because of the relinquishment of extra-territorial rights, and that it was their hope to achieve their purpose without bringing in further matters which might cause difficulty or perhaps unfortunate public discussion in China or elsewhere.

Sir H. Seymour has reported that in his view the Chinese Government are determined to use the present opportunity to make a clean sweep of all rights resulting from "unequal Treaties, and they have added
