I am medical officer in charge of Ma Tau Chung Civilian Camp. Between 11 and 12 noon on 13/3/40, I received a call to visit the Argyle Street Camp and on arrival, I saw a male, CHENG HOP. I examined him and found him semi-conscious in a dying condition.

I diagnosed a severe internal abdominal injury. I gave instructions

for an ambulance to be called.

I was next Deceased pushed Defendant said,

I am a soldier of 4th Route Army at present in Argyle Street

internment camp.

I live in No.11 hut with 60 other interned

soldiers. CHENG HOP was one of them, and defendant another. The relations between deceased and defendant were friendly. On 13/3/40 early in the morning, I started playing mahjong with defendant deceased and CHAN CHUN on deceased's bed.

At about 9 a.m., the

other 3 went for a meal and the game was stopped. Then I went for my morning meal. At 10.30 a.m., I returned and the game started again. The game continued to 11.15 when there was a fight. The deceased had 14 cards, and defendant held 13 cards. to defendant and I held 13, and CHAN CHUN held 13. one card to the centre and tried to take it back. "What do you mean by withdrawing it?" Then deceased abused defendant by saying, "Go, co-habit with your mother." Defendant answered back with the same remark. Bad words were exchanged am I told them to stop. They continued and deceased went up to defendant and hit defendant under the left eye with a swinging blow from the back of his hand. This was the only reason for the fight. The blow made defendant's cheek red and his eye water. Defendant Deceased was sitting by a bed and defendant by the end

of the bed. When deceased made to strike defendant again with his

fist, defendant tried to ward off the blow. Buth deceased made

to strike defendant again, then defendant fought with deceased with his fists. I saw defendant strike deceased between the shoulders, a second in the small of the back. Deceased was facing defendant, leaning forward and defendant struke him in the back. I intervened. Deceased picked up a bamboo broom and tried to strike defendant. I called out "Don't" and deceased did not hit defendant, for it missed, am defendant ran off, out of the hut.
