Sir,

On 2.3.40 I accompanied Mr. Cairns of the Harbour Office in No. 1 Launch to take the positions as

pointed out by Witnesses named:-

CHENG CHING PO, owner of Steam Launch SAI KUNG

LAI FUK, Coxswain of Steam Launch SAI KUNG

PANG KAM CHIU, Coxswain of Steam Launch KWONG HING

WONG LOI, Seaman of Steam Launch KWONG HING

YUEN KONG, Seaman of Stea. Launch KWONG HING.

The were all kept below after rounding Tathong

Point, and brought on the bridge one at a time, to point

out the position of the incident.

They were brought up in the order named above, and the launch steamed away from each position before the

next witness was called to the bridge.

CHENG CHING PO when making his second statement,

admitted he was confused when making the original statement,

and now insists that the trawler, the KWONG HING and T1703

were still approximately 300 yards to the East of Conic

Island, when the SAI KUNG passed them.

LAI FUK also was definite about the above

position when he made his statement and insisted that the

SAI IUNG passed near enough for him to see the Union Jack

painted on the starboard side of bridge of KWONG HING and

the red ensign aft.

The SAI KUNG passed between Conic Island and the

mainland and passed the other three craft at a distance of

approximately mile.

Sub-Inspector Olivier did not notice tacks or

strips of canvas on the painted Union Jacks.

The four positions, close together, given by the

witnesses, (except LAI FUK), are approximately of a mile
