To get back to where I broke off, if the tap on the

shoulder, which no one has suggested was followed by any

other violence, was any indication of intended violence

apart from the fact that Leung Ki looked angry, we are told

that the accused man turned round and walked some 6 feet

to the corner between the ice chest and the noodle stall and

there on top of the three boxes was this chopper. That

chopper we know the accused man picked up, then, according

to the witnesses for the Crown, he turned round with it,

he held it up, he has admitted this, to about shoulder level

and said "Don't move a hand."

Well, gentlemen, it may be good fun baiting your

debtor up to a point but there comes a time when these things

cease to be fun and become very earnest, and according to

the Crown witnesses, that time had come for both Chan Kam On

and Leung Ki when they saw that the accused had ceased to

see the joke of the whole business and had picked up this

chopper.
