Accused owed me money for a considerable time. I didn't know he

was a refugee. I don't know if he is a hawker. I don't know if he

has any parents. Leung Ki was a good friend of mine. It was just

getting dark that evening. Accused was sitting on the first stool

in photograph 2. Leung Ki was on my left when we crossed to accused.

Leung Ki told accused if he didn't pay he would not be allowed in

Chinese St. and then pushed him with his open hand. He didn't strike

accused with his closed fist. Leung Ki didn't adopt a fighting

attitude. Leung Ki Looked very angry but he didn't raise his hand.

I didn't see the chopper until accused picked it up. I didn't see

accused back until he came to the chopper. Chopper was only 3 or 4

feet from where accused was standing. I didn't see any fight

between Leung Ki and accused. I didn't run when I saw a fight.

It is not true that I ran away and saw nothing. Accused was between

Leung Ki & Des Voeux Rd. Leung Ki ran up Chinese St. When accused

standing

came up to the chopper Leung Ki was ting in the street opposite

the middle stall. I didn't hear Leung Ki call on me to strike the

accused.

When accused was talking to Leung Ki before he went to get the

chopper he could have gone away if he wished to.

Coffee stallholder: stall is just inside Chinese St. as shown in

photographs 1 & 2. On 28th Sept. about 7.30 p.m. I was at my stall.

Accused was sitting on the first stool at my stall. Leung Ho Chi

& Leung Ki were playing chess on the other side of the street. Then Chan Kam On came and asked accused to return him 50%.

Leung Ki then came up to accused and said "I'll give you 3 days

to pay this money. If you fail you'll be driven away from Chinese Stř

Leung Ki then tapped accused on the shoulder with his open hand.

They were then standing near the corner of the noodle stall.

On the top of 3 boxes beside my ice chest I had a bread chopper.

Accused when Leung Ki had spoken to him tumed round, walked up

to my stall and picked up my chopper. It was a narrow chopper
