I was frightened & cried "Step mother: uncle has a chopper and is coming here". I ran out & did not see the fight. After my mother had gone to police my father was in a deck chair in our house. Later he was moved into the kitchen near the boilers. I helped others to carry him into the kitchen. xxd. Macnamara

I had no been long in the kitchen when I saw accused pick up the chopper. I had been here some little time. I heard no quarrel between accused & my father. I had heard them quarrelling & then accused went into his house. What I heard was accused from his house shout out & my father from the kitchen replied but what he said I didn't hear. Shortly after that accused reached up for the chopper. I can't remember what they said: I couldn't understand. I did not say at Magistracy that I did not hear any quarrel. They shouted to one another but I couldn't hear what was said clearly. I was asked if my father was first to take up the chopper. I denied that. I don't know if accused got a cut on his left hand. He may have cut himself.

I live at Yung Shu An. On 22nd March about 1.30 p.m. I heard weeping from Hau Shek Po's house. I went in & saw deceased sitting in a deck chair. I helped to wrap up his head. I saw blood on his head. His head was wrapped in an old singlet. I helped to tie up the singlet properly.

Cousin of accused & deceased. I have known both of them all their lives. I know all about the family land. It was registered in name of Hau Shing Li Tong. It was transferred into names of deceased & myself. We were trustees for the family. My elder brother is trustee for the Tong. He is very old & infirm. xxd. Macnamara.

I never knew of any disputes between accused & deceased.

P.S. E187. Saikung. On 22nd March at 4.30 p.m. I started for Yung Shu Au, with three other Indiana & the widow. She took us to Yung Shu Au village to house No.4. In the house I saw a man lying in the kitchen near the boiler as in Ex. A1.

I examined him. His head was covered with a black Chinese jacket. He was alive & was wounded on the head. He said in broken English "I am dead. My elder brother hit me with a chopper today". I wrote down in this notebook what he said (Exb.L). I have translated it into English. In consequence of what widow told me I went into adjoining house. There I saw accused. He handed me this chopper (Ex.K) which was lying on the floor near his bed. I arrested him. I went back to wounded man & sent to village for help. The man died at 7.10 p.m. I took accused to Sai Kung Station, arriving at 11 p.m. I left L. S. B472 in Yung Shu Au.

I had not expected to find any wounded man there. I had no first aid appliances with me. Only dressing on wounds was Chinese jacket.
