have the honour to inform you that

application has been made to this Government by

the Trustees of the Church of England in the Diocese

of Victoria in this Colony for a site for the

erection of a Deanery for occupation by the Dean

or Senior Clergyman for the time being of St. John's

Cathedral, Hong Kong.

Difficulty has been experienced in finding

a suitable site, since already-formed vacant building

sites in the Peak District are few, and the use of the

site eventually chosen necessitates the construction

of a very expensive approach road. The construction

of this approach road will open up a few other sites

in the vicinity, but Government has not so far felt

justified in bearing the cost of its construction.

The Trustees, however, are willing to undertake the

construction of the road so far as is necessary to

give access to the proposed Deanery site.

The Trustees have requested that the site

chosen may be granted to them on special reduced

terms, in view of the fact that it will be used for

the official residence of a clergyman who is employed

by a recognized religious body working in the Colony.

Similar grants of land to religious bodies, without

premium and at nominal Crown Rents have been made in

the past, and both on account of the expense which the

lessees will incur in building the approach road to

develop this and other possible sites, as stated in

the second paragraph above, and also of the purpose

for which this site is to be used, it would seem that

a grant on special terms may properly be made in the

present case.

It is accordingly proposed to grant this

site to the applicants without premium and at a nominal Crown Rent of $1.00 per annum subject to a

restrictive covenant as to user.

Special Conditions of Grant Hereinbefore Referred To.

(1) The grantees shall not without the consent of the

Governor first had and obtained erect or maintain on the area

coloured red on plan any building other than a Deanery for

occupation by the Dean or Senior Clergyman in charge of St.

John's Cathedral.

be used, kept and maintained for the purpose for which

the same is used or is to be erected as provided by

condition (1) and shall not without the previous

licence of the Governor be used for any other purpose

whatsoever.

In case it is at any time shown to the satisfaction of

the Governor that the building upon the said lot has

ceased to be used for the purpose for which the same

was erected as provided by condition (1) it shall be

lawful for the Crown to re-enter upon the lot in like

manner as for any other breach of the terms of the

Crown Lease.

The grantees shall not sell, assign, mortgage, charge, demise, underlet, part with the possession or otherwise

dispose of or encumber the lot or any part thereof or

any building thereon without the consent of the

Governor first had and obtained.

The Crown Lease shall contain such covenants as shall

be necessary to give effect to these conditions.

(10) A right-of-way to the lot on a line to be approved by the Director of Public Works will be given. The grantees shall construct a road or path on the piece of ground over and along which such right-of-way shall be given at such time or times and in such manner as the Director of Public Works may direct and shall uphold, maintain and repair such road or path and every-
