I have laid before the Lords Commissioners of His
Majesty's Treasury Mr. Cowell's letter of the 13th January,
1939, (53971/38) enclosing a copy of a despatch from the
Governor of Hong Kong forwarding for consideration the draft
of a Bill which has been prepared empowering the Governor in
Council to grant the status of a Trust Company, subject to
certain conditions, to any corporation lawfully carrying on
banking business in the Colony.
It is observed that section 106A of the Trustee
Ordinance as proposed to be amended by Clause 2 of the draft
Bill provides that section 82 of that Ordinance shall have no
application in the case of a banking corporation carrying
on trust business, and I am to suggest for the consideration
of the Secretary of State for the Colonies that unless the
point is otherwise provided for it might be desirable to

except section 82(1)() from this provision.
