In your letter of 3rd April, 1939, reference
53899/38, you raised the question of authority required
for expenditure from the new Waterworks Renewals Fund.
I had assumed that the resolution of Legislative Council,
subsequently approved by the Secretary of State, was
sufficient authority, since statutory authority for the
payment of monies into the fund is given in the ordinary Appropriation Ordinance. However, I do not wish to dispute
the view that further statutory authority is necessary for
the actual expenditure from the fund.
After consulting with the Auditor, I think it
will suit us much better to provide this authority by a special section in the annual Appropriation Ordinance, and we propose to follow that procedure in the future. 1939 no such provision has been made in the original Appropriation Ordinance, but if you see no objection it appears to us that it would be satisfactory to cover the
