Hong Kong, 17th November, 1939.

sir,

With reference to previous correspondence

terminating with my telegram No.73 of 17th September, 1939,

regarding attacks by Japanese forces on Chinese junks

registered in Hong Kong, I have the honour to bring to

Your Excelleney's notice the case of fishing Junk No.884 H.C. which was attacked on 17th September, 1939, allegedly in British waters off She Hau in Deep Bay.

2. I enclose copies of statements taken in this connection, which contain all the known details of the

affair, The position where the junk was discovered by the police is approximately one and a half miles north-east of

the alleged paint of attack. The wrecked junk was found

by the police eighteen hours after the attack took place:

she was then lying some three miles from the nearest

Chinese waters at South Point. I am advised that it is

most improbable that the damaged junk could have drifted

in from Chinese waters during that interval under the

influence of wind and tide. This is supported by the

statements of Keung Chek and Hui Lam.

·

3. As the evidence points to an infringement of

British territorial watere in this case I should be glad

if

a protest might be lodged with the Japanese Ministry

for

His Britannic Majesty's Ambassador,

TOKYO.
