The defendant Teizo Kitayama, who having
obtained a licence had been carrying on a business in drugs until December 28th, 1937, notwithstanding the fact that the aforementioned dealer in ärugs Kenji Kitabatake had sold 41 tins (each containing 700 grammes) of anaesthetic diacetyle morphine hydrochloride to
Shinji Masuda and one other person at his shop on two
occasions, i.e. on the 16th and 24th December, 1937,
entered in his drug sales-book that the drugs were sold
to Teizo Kitayama, and consented to the use of his own name
knowing that an entry of the addresses, occupations, and
names of the aforementioned Shinichi Masuda and one other
person, who actually purchased the drugs had not been made,
and recorded in his book of receipts and disbursements of anaesthetics that he bought the aforementioned anaesthetics
for himself. By these methods he assisted and facilitated the commission of the offence, mentioned under No. 8. (B) of (3) of Kenji Kitabatake.
