10 bottles (each containing 5 grammes) of cocaine

hydrochloride, and 3 tins of morphine to Shinichi Masuda

and others on some twenty occasions during the period

from December 3rd, 1937, to December 28th 1937, entered

in the book of receipts and disbursements of anaesthetics

ag if the drugs were sold to Mutsumi Yamada, and consented

to the use of his own name knowing that the entry of the

addresses, occupations, and names of the aforementioned

Shinichi Masuda and others was not made, and entered in

the book of receipts and disbursements of anaesthetics as

if he had bought the drugs for himself. By these methods

he assisted and facilitated the commission of the offence

mentioned under No.8, (B) of (3) by the drug dealer

Kenji Kitabatake.

(2) Notwithstanding the fact that the drug dealer

Hisashi Hayashida (he was a nominal person and succeeded

the business of aforementioned Kenji Kitabatake on December

28th, 1937) sold 336 tins (each containing 700 grammes),

36 bottles (each containing 5 grammes) of anaesthetic

diacetyle morphine hydrochloride, 167 tins (each containing

450 grammes) of morphine hydrochloride, 90 tins (each

containing 700 grammes) and 50 bottles (each containing

5 grammes) of cocaine hydrochloride to Minezo Yajima and

12 others on scores of occasions during the period

between January 17th, 1938 and July 20th, 1938, recorded

in the book of receipts and disbursements of anaesthetics

as if the drugs were sold to Mutsumi Yamada, and knowing

that no entry, with regard to the recording of the addresses,

occupations, and names of Minezo Yajima and 12 others, was made

he assisted and facilitated the commission of the afore-

mentioned offence by aforementioned Hisashi Hayashida by

the aforementioned method.
