disbursed one tin
(containing 700 grammes) of anaesthetic
diacetyle morphine hydrochloride to Takumi Suzuki on
October 23rd, 1937, as is stated in (1) of No.8 while engaged
in business at 9-chome, Tanimachi, Higashiku, Osaka, failed
to enter legal particulars, such as the address, occupation,
and name of the person who received the drugs, in the
receipts and disbursements book of anaesthetics which was
provided in the aforementioned
(B)
shop.
Notwithstanding the fact that he had sold 53 tins
(each containing 700 grammes), 529 bottles (each containing
5 grammes) of anaesthetic diacetyle morphine hydrochloride,
7 tins (each containing 700 grammes) and 10 bottles (each
containing 5 grammes) of cocaine hydrochloride, and 3 tins
(each containing 450 grammes) of morphine to Shinichi Masuda,
Heiki Hitomi, Minezo Yajima, and Yuichiro Matsuoka, and
disbursed them on some twenty occasions during the period
from about December 3rd, 1937, to December 28th, 1937, as
is stated under No.8 (1) while engaged in business at his
residence, failed to enter the addresses, occupations, and
the names of the aforementioned four persons including
Shinichi Masuda to whom the drugs were disbursed, although
the fact that the drugs were sold to Mutsumi Yamada
and Teizo Kitayama was stated in the book of receipts and
disbursements of anaesthetics which was provided in the shop.

The defendant Mutsumi Yamada, a pharmacist
(he had been suspended of his business from January 21st,
1938, to March 21st, 1938) in both occasions at the shop
of Kenji Kitabatake at 1-chome Awajicho, Higashiku, Osaka;
