The Court sentences the defendant Toshio Shibata

to two months penal servitude and a fine of 100 yen;

the defendants Mantaro Asada, Shunzo Kitagawa, and

Shinichi Masuda to penal servitude for one month and 15

days and a fine of 200 yen; the defendant Shokichi Kurusu

to penal servitude for two months; the defendant Kenji

Kitabatake to penal servitude for three months and a fine

of 200 yen; the defendant Shigeru Imatomi to penal servitude

for one month and a fine of 100 yen, and the defendants

Mutsumi Yamada, Teizo Kitayama, and Kuichi Motomura to penal

servitude for one month in each case.

Whether judgment definitive or appeal being made to a

higher court.

The defendants Toshio Shibata, Mantaro Asada,

Shunzo Kitagawa, Shokichi Kurusu, Shinichi Masuda, and

Kenji Kitabatake are appealing to a higher court.

Judgment is definitive in the case of the defendants,

Kuichi Motomura, Shigeru Imatomi, Mutsumi Yamada and

Teizo Kitayama.

The defendant Toshio Shibata;

(1) In conspiracy with Min Tai Yu living in Shanghai

in the Republic of China shipped on the s. s. "Nagasaki Maru"

at Nagasaki 47 tins (each containing 700 grammes) of

anaesthetic diacetyle morphine hydrochloride on three

occasions during the period between about March 24th, 1938,

and May 14th, 1938, without having obtained a permit from

the Home Minister and without obtaining an export permit

from the Customs, and exported them to Shanghai.
