I have the honour to refer to your

confidential (3) despatch of 31st July, 1939,

approving certain substantive promotions in the

Education Department with effect from 1st April,

1939.

After considering representations made by

the officers concerned I have come to the conclusion

that the date referred to is unfair to them. it will

1938, that the post of Director of Education became

vacant on 29th November, 1938, on the retirement of

Mr. G.R. Sayer. Mr. C.G. Sollis was appointed on

probation to the vacancy, and the period of probation

being satisfactorily finished his substantive

appointment might reasonably have been expected to

take effect from the date when the vacancy occurred,

which would appear to be in accordance with the spirit

of Colonial Regulation No. 40 even if the case is not

covered by the letter of the Regulation. I therefore

recommend that his substantive appointment be amended

to date from 29th November, 1938.
