Colonial Regulation No.40, to
which reference is made in paragraph 2, reads as
follows:
"If the appointment of an officer who is acting in a vacant office is confirmed, he shall receive the full salary of that office, if available, from the date on which he entered on the duties, but from the date from which he receives such full salary he shall not be entitled to salary on account of any other office which he may have held at the same time".
The Governor admits that it would be in accordance
with the spirit of the Regulation, though certainly
not the letter, for Mr. Sollis's substantive
appointment as Director of Education to date from
29/11/38, i.e. the date of retirement of the previous
holder of this office, Mr. Sayer. Mr. Sollis was
appointed to the vacancy on probation in the first
place, the period of probation to last for at least
six months (see paragraph 5 of 37 on 23177 C.R.);
and at 39 on that file the Governor recommended that
he should be confirmed in the post.
The recommendations concerning the other
officers mentioned in this despatch are consequent
upon approval being given to the Governor's
recommendation that Mr. Sollis's substantive
appointment be amended to date from November the
29th, 1938.
I suggest that No. 5 might be considered
before the other despatches on this file on which
action is outstanding, and ? the file should go to
C.S.D. in the first place.
