With reference to Foreign Office telegram

No.12 (Saving) of 14th December, 1938, addressed to you,

I have the honour to forward for necessary action the

accompanying statement of claim against the Japanese

Government for damages, amounting to $1,450 Hong Kong currency, in respect of the death of one and wounds to

two other British subjects resident in British territory,

which resulted from Japanese firing into British

territory during the Japanese attack on Shan Chun and

districts on the borders of the New Territories of this

Colony. on 26th November, 1938.

The compensation for injuries has been

assessed at the rate recently admitted by the Japanese

in respect of those wounded in the incident of 21st

February, 1939. The compensation for the man who wis killed, however, has been assessed at a higher rate than

that admitted for deaths in the incident of 21st February, 1939, since inquiries have revealed that the father of the deceased man was dependent to the extent

of about $20 per month on his son, who was in good remunerative employment in Hong Kong. The cirowastances
