5. Section 5 of the Banking Ordinance. 1921, as amended by section 1 of the Banking Ordinance. 1922, shall be deleted and the following section shall be substituted in the place thereof :--

5.-(1) Every company and co-operative society carrying on banking business shall:-

(a) furnish to the Registrar of Companies, not later than

the first day of March of every year :—

(i) a statement showing the situation of its offices and branches in Palestine, the names of its directors and the names of managers of its branches and the names of its agents in Palestine:

(ii) an audited statement for the preceding financial year of the company in the form set out in the first schedule to this Ordinance of its assets and liabilities in Palestine and also a similar statement of its assets and liabilities outside Palestine:

Provided that in the case of a foreign company. the official balance sheet of such company issued in the country in which the company has its head office may be submitted, unless the Registrar of Com- panies shall require a separate statement in the form set out in the first schedule to this Ordinance of the assets and liabilities in Palestine to be filed

for the confidential information of the Governinent and not for publication:

(b) furnish to the Treasurer :—

(i) not later than the first day of March of every year a copy of the audited statement required under para- graph (a) (ii) of sub-section (1) of this section; (i) not later than twenty-one days after the last busi- ness day of each month a statement in the form set out in the second schedule to this Ordinance show- ing the position of the company or society in Pales- tine at the close of the business on the last day of the preceding nonth: Provided that the High Com- missioner may by order from time to time vary the form so set out in the second schedule to this Ordinance.

(2) A copy of the statement referred to in paragraph (a) (ii) of sub-section (1) hereof, or of such summary or particulars thereof as may from time to time be directed by the Registrar of Companies with the approval of the High Commissioner shall be posted in a conspicuous place in every office or branch of the company in Palestine for a period of one month under

a penalty of five pounds a day during default and shall be pub- lished by the company in the Gazette and in a newspaper circulating in Palestine.

(3) Every member and every creditor of the company shall be entitled to a copy of the statement referred to in paragraph (a) (ii) of sub-section (1) hereof upon the payment of a fee of twenty mils."'

The schedule to the Banking Ordinance. 1921. shall be de- leted and the schedules set out in the schedule to this Ordinance

shall be substituted in the place thereof.
