RULES for the control of the Recruiting of Labourers

These Rules are drawn up in accordance with the provisions of Article 6 of the Ordinance governing the Emigration of Labourers.

All those who recruit labourers for abroad, irrespective of whether they are individuals or legal corporations, shall be termed Recruiting Agents and shall be governed by these Rules.

A Recruiting Agent shall, before commencing to recruit labourers, submit an application through an Overseas Affairs Bureau or district or municipal government to the Commission on Overseas Affairs, which, on approving his application, shall issue to him a special recruiting license.

The application must contain the following particulars:

(1)

The name, age, native district, previous record, and address of the Recruiting Agent or of his representative, together with two copies of a recent 2-inch bust photograph.

(2) Address of the recruiting office and branch

recruiting offices.

(3) Total capital for recruiting purposes.

4) Particulars of the organisation and class of

factory recruiting labourers.

Total number of labourers required.

Place of recruitment.

(7) Class of work.

Copy of agreement concluded between the employer and the recruiting agent or of the employer's written authority.

(10) Where the recruiting agent is a foreign national

a certificate from his Consul at the place of recruitment or nearest consulate thereto shall be produced.

(11) Term of recruitment.

Guarantee from reliable firm established in

China.

In addition to the above stipulations, the recruiting agent shall, while representing the employer in concluding agreements with the labourers, conform to the Principles governing Contracts for Labourers proceeding Abroad, and the contracts shall be chopped by a reliable firm established in China as guarantee.

The period allowed for the recruiting of labour- ers axixiám shall not exceed one year.

The recruiting agent may not recruit labourers outside the area stated in his license.

On his application for a license having been approved by the Commission on Overseas Affairs, the recruiting agent shall pay a fee of Twenty dollars in addition to Two dollars stamp duty.
