whether belonging to foreigners, or Chinese, shall, prior to their departure abroad, enter into a contract with the employer in accordance with the principles of these regulations and such contracts shall be submitted to the Overseas Affairs Committee for approval. The contract shall be prepared in both English and Chinese, in quadruplicate, with four 2-inch bust photographs of the labourer. Of these four copies of the contract one shall be transmitted to the Overseas Affairs Committee for record, one to the Consul for China at the place of labour while one copy each shall be retained by the employer and labourer. The form of contract shall be laid down by the Overseas Affairs Committee.

The contract which shall be signed by both labourer and employer, and to which the employer shall produce a shop guarantee, shall be witnessed by the local Overseas Affairs Bureau or the local authorities or by a Labour Union.

The contract must contain the following particulars:

Name and nationality of employer; name of factory or corporation; place of work.

Name of labourer; sex; age; native district; skilled or unskilled; and addresses in China and abroad.

The total number of labourers required and the class of work.

Period of employment from (date) to (date).

receive weekly or daily wages must be entered separately).

Hours of work per day.

Holidays and number of days sick leave allowed per year.

Fare of labourer on return home after the completion of term of service payable by whom; how advances to labourer are repayable.

Board and Lodging of labourer, by whom supplied.

The employer shall insure the life of labourer if the work is of dangerous nature.

The poll-tax and similar taxes levied on the labourer at the place of work shall be paid by the employer.

The amount of compensation to be paid to a labourer, in the event of his being injured or killed in the performance of his work.

On the closure of the factory or corporation before the termination of the contract, the employer shall pay the return fare of the labourer to China and shall also compensate him for any losses suffered.
