to Colonial Office I would like to associate myself with
the Governor Hong Kong in his proposal that in order to
avoid incidents Japanese should refrain from exercising
right of passage of Hong Kong waters. H. M. S. DARING
informs me that Japanese Destroyers had passed close to
Stanley Point and through east Lamma and Kap Sing Terry
Channel before committing equivalent to an act of war
in capturing Chinese customs vessels. Some authorities
consider right of innocent passage does not necessarily
extend to men of war and anyhow warning Japanese at this
stage will be useful should any (corrupt group) more than
one occasion in recent years Japanese have shown themselves
capable of abusing Hong Kong territorial waters. It is
observed that destroyers and light draft vessels can avoid
Hong Kong waters in approaching Canton river keeping west
