That, when identical circumstances arose in the

Department in 1920 the Engineer most suitable, and who was not

the officer next senior in the Department, was promoted to

Executive Engineer in charge of the vacant office.

That, this promotion occurred at a time when the former General Order 11 (old Colonial Regulation 25) was in force.

That, Government has informed the Head of the Department

and the petitioner that it is not favourably inclined to

recommend the provision of the additional temporary post proposed

in paragraph 19, the reason advanced being that advantage of

the conditions of both the former and current General Orders 11

was being requested.

That, accordingly, Government proposes: -

·

(a) to recommend, again, for promotion the two Engineers

next senior in the Department and

(b) the petitioner shall continue in his charge of

the Waterworas Construction Office in an acting

capacity only.

That, the result of these proposals would be:

(a) one of the officers promoted to Executive Engineer

would take charge of the office in which the said

officer is now acting as Executive Engineer,

(b) the other officer promoted to Executive Engineer

would still be performing the duties normally

carried out by an Engineer and

(c) the petitioner would continue to carry the

responsibilities normally borne by an Executive

Engineer while remaining a substantive Engineer

for a probable further period of two years.

That, the proposals contained in paragraph 25 indicate

that Government is still regarding seniority as the principal factor in deciding claims for promotion.
