New Section 358. I do not much care for
this section. Would it not be possible to define
more exactly what is to be savings bank business,
in particular by using some better word than
"minor" or "small", and leave it to a court to
say whether a banking company is or is not a
"Savings Bank Company" within the terms of the
Ordinance? If the proviso is to remain, I think
that clearly the words "notwithstanding anything
contained in this section" should come out
since the Governor in Council should be guided
by the previous provisions in arriving at their
decision whether a company is conducting a
savings bank business.
And also if the proviso
is to remain it should be made clear that on
the Governor in Council's declaring that a
business is a savings bank business the company
should be given ample time after the date of
the declaration to comply with the terms of the
Ordinance, for example Section 359.
