I have to refer to your letter dated 9th April 1954, and to inform you that the proposals submitted thereunder have been carefully considered at a recent Departmental Land Conference.

As a result of such consideration I have to inf om you that this Department is not prepared to recommend the proposals as shown on the plan accompanying your letter under reference as the same represent a development which is considered to be far too intensive.

This Department would however be prepared to consider proposals envisaging the erection of three separate blocks of
the combined portions of the lots fronting Kun Tong Road with two additional separate blocks of flats on the combined pear
areas.

This Department would further be prepared to recommend the removal of the restrictive convenants relating to the portions of the above lots coloured green on your plan (fronting Kun Tong Road) subject to the payment of an additional premium, to be later calculated, to permit of the erection of the buildings as indicated in para. 3 hereof, subject to your client obtaining letters of consent from the owners of N.K.I.Ls. Nos. 63 and 166. It is the considered opinion of the Crown's Legal Department that each of the lessees of N.K.I.Ls. 63, 166, 167 and 168 could enforce the restrictive covenant against the others and also against the Crown as lessor, and accordingly the owners of N.K.I.Ls. Nos. 63 and 166 might be successful in obtaining an injunction prohibiting the Crown from granting permission to build on the areas coloured
green.

Under the circumstances therefore the first step is obviously for your clients to approach the owners of .K.I.Ls. Nos. 63 and 166 and seek to obtain from their letters of consent to the erection of buildings as set out in para.3 hereof.

No further action can be taken on your letter of the 9th April 1954 pending action as suggested in para. 5 above.
