was subject to one year's probation on transfer (vide Sir Philip Cunliffe-Lister's despatch No. 236 of 27th June, 1934) and was duly confirmed in his appointment as reported in Sir W. T. Southorn's despatch No. 592 of 9th November,
He therefore takes seniority over Mr. Wilby.

1935.
In the terms of Colonial Regulation 38, the seniority of Messrs. Dyer and Walton is determined by reference to the dates of their arrival in the Colony and
Mr. Dyer should, on confirmation, be senior to Mr. Walton. Mr. Dyer, however, owing to the longer period of his probation, will not be confirmed before 6th September, 1936.

It seems impossible to give Mr. Wilby the seniority promised in the telegram of 8th August last to Nigeria and at the same time to grant to Mr. Dyer and to
Mr. Walton the seniority to which they would seem to be entitled by Colonial Regulation 38. Mr. Walton is senior to Mr. Wilby both by the telegram and by Colonial Regulations. Mr. Dyer is junior to Mr.. Wilby according to the telegram but should according to Colonial Regulations become senior to
Mr. Walton and therefore senior to Mr. Wilby on confirmation.
