for public use, Government intimated that it was
prepared to consider a contribution towards the
cost of construction on a basis of 40% of the
total, and to maintain the road when constructed
at its own expense as a public road.
On representation from the Air Authorities that
the matter was urgent, and on obtaining from them an assurance
that the Air Ministry would pay whatever sums might by arbitration or negotiation be payable to expropriated private
owners, the Colonial Goverment proceeded without delay to
negotiate with the private owners concerned for the surrender
of their land on the site. These negotiations were
unsuccessful and action under the Crown Lands Resumption
Ordinance was at once taken. The legal notice required by
that Ordinance will expire during the last week in Jamary,
when it is anticipated that the areas on which it is desired to start work most urgently will be at the disposal
of the Air Authorities.
4.
Detailed terms for transfer of the Pat Heung
site are meanwhile under discussion and I shall forward the
terms for your approval at the earliest opportunity.
