I am directed by Secretary Sir Samuel Hoare to transmit

to you herewith, for such action as the Secretary of State for

the Colonies may consider possible, a copy of a note from the

French Ambassador, enclosing a Commission Rogatoire issued

by the Court of First Instance of Mont de Marsan, France, for the interrogation of Henri Jusserand, residing at Hong Kong, who is accused of fraud and of offences against company

law.

2. Sir Samuel Hoare desires in this connexion to invite

attention to the printed Memorandum (Section II, Section III or Section IV) a copy of which was enclosed in the letter

from this Department T 10066/10066/371 of 27th August 1935 and to state that he considers it probable that, if the present

request was one to be executed in England, it would probably be treated as coming under either section III or section IV. If

Mr. Secretary MacDonald considers it probable that the

authorities in Hong Kong will be prepared to execute it in one of these ways, Sir Samuel Hoare will, if it is desired, request the French Ambassador to supply an English translation of the request (see Section III paragraph 4,1ast sentence of the

memorandum).
