sir,
I have the honour to enclose, for Your Excelleney's
consideration, a copy of a communication which I have
received from the Secretary General of the Shanghai
Hunicipal Council calling attention to the fact that by
the amendment introduced into the liongkong Companies
Ordinance by Ordinance No.29 of 1933 the Comcil was
deprived of its legal claim to priority in respect of
rates due by China companies in liquidation, and express-
ing the hope that it may be possible to restore the
former position.
2. Vith regard to the extent to which the matter
is of prectieal importance to the Council, I learn that
during the past two years the Council has twice received
priority in respect of claims for rates in the winding
of China companies, but that in a case now proceeding
priority has been refused owing to the amendment in the
Ordinance. I am also informed that the Council receivé
preferential treatment where winding up takes place
under the jurisdiction of the Belgian, French and
Netherlands authorities.
3. It would certainly appear that the position of
authorities such as the Shanghai mieipel Comcil was
overlooked when the amending Ordinance No.29 of 1933 was
passed, and I venture to suggest to Your Excellmcy that
cese is one which calls for remedial measures.
