In 1903 the Hong Kong Government issued an

Order dated the 26th of June, 1903, under which foreign

men-of-war were not allowed to anchor elsewhere than in

extended the old one that had appeared in earlier Orders.

So far as he was aware, no foreign Power had raised

objection to the old Orders, and he and the Commander-in-

Chief were both of opinion that the principle of the Order

of the 26th of June, 1903, should be allowed to stand.

The Admiralty, however, on being consulted, adhered to the view which they had previously expressed,

that no steps should be taken which might by force of

example cause other Powers to place restrictions upon the

free movement of British men-of-war in territorial waters,

and accordingly requested the early modification of the

Order of the 26th of June, 1903. (Admiralty letter Confidential M.0377 of the 30th of March, 1904).

In his despatch of the 20th of March, 1904, to

Hong Kong, the then Secretary of State for the Colonies

accordingly requested the Governor to withdraw the Order

of the 26th of June, 1903, and to substitute a Harbour

Regulation prohibiting foreign ships of war or their boats

from carrying out examinations or surveys of the shores

or waters of the Colony, and prohibiting the landing of

foreign soldiers or sailors from any vessel without the

permission of the Governor obtained through the Consular Officer of the country to which the troops belonged.

In his Confidential despatch of the 10th of

August, 1904, the Governor of Hong Kong reported that he

had accordingly issued Regulations dated the 5th of July,

1904, under the Merchant Shipping Ordinance, 1899, in

accordance with these instructions. The Rules of the

26th of June, 1903, were rescinded.

A copy of the Regulations of the 5th of July 1904

is attached. These Regulations have since been modified

at various dates (13th of December, 1907, 1st of February,

1909, 19th of July, 1909, 7th of September, 1909, and

31st of May, 1910). A copy of the Regulations of the

31st of May, 1910, which are at present in force, is

also attached.
