We beg to acknowledge receipt of your letter of

(1) yesterday, enclosing a copy of a Despatch dated the 9th ulto.,

from the Governor of Hong Kong, dealing with this matter.

It will not be possible to make any arrangement for

postponing the hearing of the application for special leave to

appeal, as the Petitioner is lying under sentence of death, and

has only been respited until the 17th of this month.

This, however, will not prejudice the Crown's Case

in any way as the facts of the Case are fully set out in the

Petition for Special Leave to Appeal.

The Notice of intention to apply for special leave to

appeal having been served on the proper officer in Hong Kong,

the Petitioner is in a position to have his application set

down for hearing without any Caveat being entered on behalf of

the Crown, and we were therefore obliged to enter a Caveat

forthwith in order to obtain a copy of the Petition

us to instruct Counsel in time for the hearing.
