The estate of one Raphael Emanuel Belilios,

who died in Hong Kong in 1905, was vested in Trustees

named in his will; viz: Mrs. Vera Carlotta Belilios

(or Bellairs), and Messrs. Richard Owen Roberts and

Edward Elvey Robb. A life interest in the estate was

taken by the son of the deceased, E. R. Belilios, who

died in Hong Kong in October 1922. In accordance

with the provisions of Section 2 of the Estate Duty

Ordinance (No. 3 of 1932), the beneficial interest

in the estate ceased on the death of E. R. Belilios

and passed under the provisions of the Ordinance,

thus entailing obligations as to the delivery of an

account to the Estate Duty Commissioner, Hong Kong,

and payment of estate duty in Hong Kong.

No such account was received nor payment

of estate duty made; and in accordance with Section

10, Subsection 12 of the Ordinance, a Notice was

duly served, through Messrs. Burchells, on

Mrs. Bellairs and Mr. Robb, Mr. Roberts having died

in 1929, calling upon them to disclose the estate

and to remit the duty payable thereon. Mrs. Bellairs

and Mr. Robb refused to sign the affidavits, but

admitted that they were the persons named. Apparently

no account was rendered nor payment made within the

time specified in Section 10, Subsection 12 of the

Ordinance, and writs of subpoena claiming payment

of the estate duty due were, again through Messrs.

Burchells, served on the surviving Trustees, in

pursuance of the procedure laid down in Section 10,

Subsection 14 of the Ordinance.

This service has apparently led to no result

and an Order has been obtained from the Supreme Court

of Hong Kong for the sale of certain properties for

the recovery of the estate duty due.

The properties in question are valued by the

Public Works Department at a total value of $43,250;

but under present market conditions it is not expected

that they will realise anything like these figures.

It is accordingly proposed that the Government should

bid for these properties, up to their value as estimated,

since the properties are good in themselves, and

furthermore would be useful in connection with the

rebuilding of the Peak School. The transaction is

tantamount to:-

from

(a) writing-off the estate duty claimable

for the Belilios estate,

free

(b) acquiring at a moderate figure land

which is quite valuable in itself and which may also

be useful in connection with Government building.
