RESPECTFULLY SHEWETH :-
1. THAT on the 9th day of August 1934, your Petitioner was committed by E.W.Hamilton Esquire
a Police Magistrate of the Central Magistracy of Hong Kong, for trial at the August Criminal
Sessions 1934 before the Supreme Court of Hong Kong on the charge that
"he the said Ng Loi Yuen, on the 22nd day of June 1934 at Victoria in the Colony of
Hong Kong, feloniously wilfully and with malice aforethought did kill and murder one
Michael Pine against the Peace of our Lord the King his Crown and Dignity"
2. THAT on the 18th day of August 1934 an indictment was prepared by the Attorney General of
the said Colony of Hong Kong against your Petitioner charging him with the following offence:-
STATEMENT OF OFFENCE
Murder.
PARTICULARS OF OFFENCE
"Ng Loi Yuen alias Ng Yik Lam alias Ng Yik Sam on the 22nd day of June, 1934, at
Victoria in this Colony murdered Michael Pine.
Common Law. (Section 2 Ordinance No. 2 of 1865)
3. THAT your Petitioner was tried before His Honour Mr. Alasdair Duncan Atholl MacGregor the
Chief Justice of the said Supreme Court of Hong Kong and a jury on the charge set out in the said
indictment on the 21st 22nd and 23rd days of August 1934 and such Jury failed to agree and were
discharged.
4. THAT at the trial of your Petitioner upon the said charge on the said 21st 22nd and 23rd days
of August 1934 evidence was adduced by the Assistant Attorney General on behalf of the Crown as
proving or tending to prove the following acts deeds matters or things :-
(a)
That on the 22nd day of June 1934 Michael Pine aged 8 years was playing with his twin
