murdered Michael Pine

3. That your Fetitioner was tried before His Honour MI.
Alasdair Duncan Atholl MacGregor the Chief Justice of the said
Supreme Court of Hong Kong and a jury on the charge set out in
the said indictment on the 21st 22nd and 23rd days of August
1934 and such jury failed to agree and were discharged.
4. That at the trial of your Fetitioner upon the said
charge on the said 21st 22nd and 23rd days of August 1934
evidence was adduced by the Assistant Attorney General on
behalf of the Crown as proving or tending to prove the follow-
ing acts deeds matters or things :

That on the 22nd day of June 1934 Michael Fine aged 8
years was playing with his twin sister Mary Pine and
three other chilaren on a bridge over a nuliah down
which a considerable quantity of water was flowing.
That your Petitioner was also on the bridge at the
same time.
That your Petitioner picked up all the chiluren
including the deceased Michael Pine end threw them
over the bridge into the nullah and then jumped in
himself.
That five children were seen in the nullah, and all
the five children were rescued alive but that Michael
Pine died later in the same day from a fracture of the
skull consistent with a fall into the nullah.
(e) That your Petitioner on the same day and approximately
the same time, was found standing with his back against
the wall of a dark portion of the tunnel which was 2
continuation of the nullah.
