I have somewhat recast the form of the
draft telegram, while retaining Mr. Bushe's
formula as to the constitutional position of the
S. of S. and the Governor in these matters.
It seems preferable to ask the Governor to
reply to the Bishop rather than merely to make him
from
the channel of a direct communication the S. of S.

Lord Plymouth has seen the telegram which
was sent to the Governor of Hong kong upon this matter,
and he thinks that I might possibly reply to Dr. Oldham
by furnishing him with a copy of it.

what terms you suggest the reply should be in?

I recirculate these papers for
consideration whether the Bulletin Notice at
(2) on 61063/29 does not require to be
modified.
Paragraph 4 of the Bulletin Notice
(on which the action suggested by me in my
minutes of 10.12.34 on this file and 30.11.34
on 33858/34 was based) contains the following
passage:-
"Also it is incumbent upon him (the
Secretary of State) to investigate, and,
if necessary, to intervene in individual
cases which are brought to his notice,
where there seems to have been a
miscarriage of justice."
This passage appears to me to be
inconsistent with the first and second
sentences of the Secretary of State's minute
of 14.12.34. It would appear, therefore, that
the Bulletin might with advantage be amended.
