Supply of Rolling-stock for Through Goods Trains,

Article 21. The Rolling-stock for Through Goods Trains run prim- arily for the conveyance of Terminal Through Traffic shall be supplied by the two Sections in the ratio of eighteen Chinese Section wagons to seven British Section wagons, one 30-ton wagon being taken as equiva- lent to two 15-ton wagons. Any departure from this ratio shall result in the payment to the Section supplying the excess wagon or wagons, of such charges for hire and demurrage by the other Section as are laid down in Schedule "B" attached hereto.

Article 22. The Rolling-stock for Through Goods Trains run primarily for the conveyance of Sectional Through Traffic shall be sup- plied in accordance with the best traffic arrangements that can be made to deal with such traffic, all wagons used in conveying this traffic being subject to such charges for hire and demurrage as are laid down in Schedule "B".

Supply of Rolling-stock for Through Mixed Trains.

Article 23. The supply of coaches for Through Mixed Trains shall be in accordance with Article 19 and the supply of wagons for such trains shall be in accordance with Articles 21 and 22. Schedules "A" and "B" respectively shall apply to coaches and wagons used on these trains.

Cleaning, Oiling and Stabling of Rolling-stock of Through Trains.

Article 24. Arrangements shall be made by the two Administra- tions for the stabling, cleaning and oiling of passenger coaches and goods wagons employed in Through Traffic and the estimated cost thereof shall be borne by each Section in the proportion of Chinese Section seventy-two per cent and British Section twenty-eight per cent, such cost being mutually agreed upon by the two Administrations.

Interchange of Rolling-stock,

Article 25. Regulations for the delivery and receipt of Rolling. stock and the detailed procedure for inspection preparatory to such delivery and receipt shall be mutually agreed upon between the two Administrations.

Through Rates and Fares.

Article 26. Competitive rates and fares for Terminal Through Traffic shall be mutually agreed upon between the two Administrations and shall be published in the Rates and Fares Schedules.

Article 27. All rates and fares for Sectional Through Traffic shall normally be the sum of the local rates and fares, but for the purpose of stimulating traffic the two Administrations may mutually agree to make proportionate reductions in these through rates and fares which shall then be known as "Special Rates and Fares".

Article 28. Special Terminal Through Rates for the conveyance of goods may be quoted and used by either Section to obtain traffic which might otherwise be lost to the Railway provided that full details of such rates and the reasons for same are immediately forwarded to the Section to which the goods are consigned.

Article 29. Each Section shall periodically hand to the other Section its own local rates and fares schedules. The fares in these schedules shall normally not exceed nine and a half cents, six and a half cents and three cents Hong Kong currency per mile for First, Second and Third Class passengers respectively although maximum fares computed on this basis may be brought to the nearest five cents.

Article 30. Rates and Fares Schedules governing Through Traffic shall be prepared in accordance with Articles 26 and 27 in this Agree- ment and be agreed upon by the two Administrations. All such schedules shall be drawn up in Chinese and English and posted conspicu- ously at each station.

Article 31. Through rates for goods traffic and for the carriage of dogs, horses, passengers' baggage and parcels shall be embodied in a rates schedule known as the "Tariff Book"; these rates shall be mutual- ly agreed upon by the two Administrations having due regard to outside competition.

Article 32. In the Through Rates and Fares Schedules for use on the Chinese section, each of the rates and fares shall be stated in Canton currency, and in the Through Rates and Fares Schedules for use on the British Section, each of the rates and fares shall be stated in Hong Kong currency. The exchange rate between Canton and Hong Kong curren- cies for the calculation of through rates and fares shall be the "Trans- action Rate" as defined in Article 34,

Provisions governing the Division of Through Rates and Fares. Article 33. The sharing of through rates and fares between the Chinese and British Sections shall be according to the regulations pro- vided below:--

(i) The Chinese Section shall receive from the British Section in respect of Up Traffic:-

(a) Seventy-two per cent. of the Terminal Through Traffic re-

ceipts in Hong Kong currency.

(b) Its own local rates and fares for Sectional Through Traffic in Hong Kong currency as set out in the fare table in Hong Kong currency or as set out in the Tariff Book in Hong Kong currency or as has been mutually agreed upon between the two Administrations in Hong Kong currency.

(ii) The British Section shall receive from the Chinese Section in respect of Down Traffic:-

(a) Twenty-eight per cent of the Terminal Through Trafic receipts converted into Hong Kong currency at the Current Rate of Exchange as defined in Article 35.

(b) Its own local rates and fares for Sectional. Through Traffic as set out in the fare table in Hong Kong currency or as set out in the Tariff Book in Hong Kong currency or as has been mutually agreed upon by the two Administrations in Hong Kong currency, such rates and fares being converted into Canton currency at the Transaction Rate in force at the time and reconverted into Hong Kong currency at the Current Rate of Exchange.

Article 34. The "Transaction Rate" referred to in Articles 32 and 23 shall be the average selling rate of exchange between Canton currency and Hong Kong currency during the six months preceding
