I am directed by Secretary Sir John Simon to refer
to the correspondence contained in Foreign office letter
No. P 5310/6310/10 of 30th August regarding the place of
confinement of Harold James Owen Hicks, who was sentenced at
Tientein in June last to be kept in custody as a criminal
lunatic until His Majesty's pleasure should be known.
2. A reply has been received from the Colonial Office
copy of which was sent direct to the Home Office, in which
the Secretary of State for the Colonies states that he is not
in a position to suggest any British poBression in the Fast
to which Mr. Hicks could be sent.
3. The question therefore now arises, under the
provisions of the enactmente cited by the Acting Judge of His
Majesty's Supreme Court, Shanghai, in his despatch No.14 of 26th
June, of the removal of Mr. Nicks from his present place of
confinement in Chine to some suitable place of detention in
the United Kingdom.
Sir John Eimen would be glad to receive the
observations of Secretary Sir John Gilmour on this matter, and
to learn whether he would agree to the Secretary of State taking
steps, conjointly with His Majesty's kinister in China, with a
view to securing the removal of ar. Hicks to the United Kingdom.
