I have received note from Waichiaopu (copy sent by post

to you) requesting me to make urgent representations to

His Majesty's Government to abandon scheme for construction

of public park in Kowloon City involving evacuation of Chinese

residents and contending that proposed action is contrary to

convention of 1898. In reply I am acknowledging receipt and

stating I am communicating with Governor of HongKong on the

matter.

Governor states in reply to my telegram that Order in

Council of 1899 revoking special status of Kowloon City seems

to have been overlooked; that in any case removal of

inhabitants will not be required until 1934 and that he is

investigating the matter further and will let me know decision

in due course.

I am not aware how far Chinese government ever acquiesced

in our taking over jurisdiction in Kowloon City or how far

Order in Council was based on Chinese acquiescence; or if not

on what ground our action was based. These points will be

looked up as being cardinal to the issue now raised by

Chinese government.
