China Piracy.
This matter was ultimately discussed between
Sir Maurice Gwyer and the Attorney General on Wednesday
last and, as a result, the question to be put to the Privy Council was settled in the form shown on the last page of
the revis ed draft Order in Council which I enclose. You
will observe that the desired extension of the terms of
reference has not met with the Attorney General's approval;
he is averse from taking the risk of the matter being styled
wholly hypothetical, an observation which would fall all too
easily from some of the possible members of the Court.
It does not appear that any further or more
formal reference to the Law Officers is ne cessary;
the terms
of reference are substantially those settled in the Opinion.
May I assume therefore that you will set in motion the ne cessary steps to have the matter referred accordingly?
