Potter

The objection to the evidence of Simser and Cristie

who allege that they were incited on the 21st March and

shortly before, i.e. from the 10th March, by accused

to compass the death of Fung.

If the evidence is admitted I shall rais ask for the

point to be reserved under 5.78 if necessary.

I agı

I shall also ask for the question of the adminaibility

of the alleged threat to shoot (p.19) to be reserved.

That has not been definitely admitteủ.

There is no connexion between the alleged interview

on the 21st March and the incidents of the 24th March, or

between it and the crime alleged which is a counselling

Chui

of one Qui and one Fong to murder Jung,

9 Halsbury, pp 380, 381. Archbold, 28th, p.365.

There is no issue here to which this evidence could

be relevant.

Lindsell referred this evidence

the second

heading of evidence mentioned in his opening, ins. devirs

and deliberate intmtion an the part of the accused to

get Fung killed,

If the Crow prove an incitement through Lam of

two man to shoot hung no question of intention arises.
