I pass on to the second part of the evidence of the Crown; that

ia the evidence of desire and deliberate intention on the part

of the accused to get George Fung killed.

This second division of the evidence is based mainly on

what I cannot describe otherwise than as tainted evidence, the

evidence of two Eurasiane who admit they encouraged up to a point

the accused in his foul design, though not with the intention of

accomplishing Fung's death, but by some means getting hold of

the money the accused was willing to pay if that death came about.

The first of these Eurasians, Edward Zimmern, a member

the black sheep I fear

teep I fear - of a well-known and respected Hong Kong

family, obtained the acquaintance of the accused on the 5th March

at the first extra race meeting on that day. He was subsequently

engaged by the accused as his follower or body guard. He already

knew Tung but did not know of the Lai affair. The will tell you he

first heard of this when in a car with the accused some day or two

after the 5th March. On another occasion, he will tell you, that

when also in the car with the accused, the accused told him the who]

circumstances of the girl leaving him for Fung and that she was

then a virgin.

21-mern met the accused by arrangement at the South

China Athletic Association in Queen's Road Central and accompanied

him to restaurants at West Point. One night, about the 17th March,

on leaving West Point the accused a peared very nervous and worried

and excited. Accused told him, "I want to do for Fung. Can you

get me a knife so I can go to the than Hotel and have it ut

with him?" Zimmern tried to pacify hia and get håa hone.

A day or so later - a date which he now fixes as the

19th March when on the way to West Point in the car with the

accused, Zimmern will tell you fu ther thatthey had another

conversation when the accused told hia that on the night previous

he had been over to the Nathan Hotel and had got the couple out of

their room by means of a faked telephone message, and had warned

them
