8. The Prisoner was the only person who had a motive for
murdering Fung, according to the evidence. There was
evidence that Fung had no enemies in Hong Kong other
than the Frisoner.
Fro those facts the jury must have drawn the inference that kau was employed by the Frisoner, though
it is enough to show that they could reasonably come to
that conclusion.
I understand that the point of Jenkin's examination
of the summing-up is that even if the court decides that
the evidence objected to is admissible yet the court will
have to consider whether any substantial miscarriage of
Justice has occurred. That is a matter for the sourt,
and I shall not argue it.

a prima facie case of proof of agency. The evidence
enumerated leads only to conjecture. I go further, and
say that if you draw any inference at all it should be

Isoe. As regards the point on the remarke coincidence,
it is answered by Zimmern's evidence, a Zimmern ways
that Prisoner said that Lại Ming Fai had rung up and sworn
vengeance.

the Frisoner told him that.
