I have laid before the Lords Commissioners of

His Majesty's Treasury Mr.Calder's letter of the 25th

the instant (92690/32) relative to Opinion of the Law

Officers of the Crown regarding the judgment of the Full

Court of Hong Kong in the piracy case of Rex v Chung Tam

Kwong and others, in the course of which it was stated

that the case was a proper one for special reference to

the Judicial Committee of the Privy Council under

Section 4 of the Judicial Committee Act, 1833, should His

Majesty think fit.

My Lords note that the Secretary of State is of

opinion that the special reference suggested by the Law

Officers should be made and in these circumstances They

raise no objection to the use of the services of the

Treasury Solicitor's Department in this matter. On the

information before Them, however, They see no reason why the costs of the reference should fall on the Vote of
