Sir,
I have, etc. to refer to
your despatch, No. 522 of the
22nd Decr. 1931 on the subject
of the law of piracy, and to
inform you that His Majesty's
Government is advised that the
Full Court of Hong Kong was
wrong when it decided to quash
the conviction of the twelve
prisoners in the case of Rex
v. Chung Tam Kwong and others.

The indictment,
verdict and conviction
appear to
have been proper upon the facts, and if,
on a future occasion, a similar
case were to arise of an
unsuccessful attack by pirates, H.M.G. is advised that
the Hong Kong Court would be
