You will see that the Law Officers
advise special reference to the Privy Council under
section 4. There are certain technical objections
to the course, which are shown on D.0.papers herewith
(10761/28 and connected papers), and on Jamaica 76002.
However, we must distinguish this case on the ground
that no appeal is possible to the Privy Council.
In due course we must take this up with
the Lord President of the Council and get him to agree.
In the meantime, however, the immediate question is
that of the cost. I have spoken to Sir Maurice Gwyer
who says that he will write to the Treasury and ask
if he can bear it on his vote, and will let me know.
If the Treasury won't agree to that, I think we must
insist upon Hong Kong paying, since this embarrassing
decision was given by their Judges, and is, we are
advised, erroneous. We must wait for a further
communication from Sir Maurice Gwyer, and, in the
meantime, you may like to see the Opinion.
